YOU AND WE THEREBY EACH AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL, AND AGREE THAT YOU AND WE MAY BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Cancellation and Refunds

Cancellation Policy: Tickets purchased for Afrobeat Rhythm and Wine Festival events are non-refundable, except as expressly provided in this section or as required by law.

Event Cancellation: In the event that Afrobeat Rhythm and Wine Festival cancels an event for any reason, ticket holders will be entitled to a full refund of the ticket purchase price. Afrobeat Rhythm and Wine Festival will make reasonable efforts to notify ticket holders of event cancellations and refund procedures.

Force Majeure: Afrobeat Rhythm and Wine Festival shall not be liable for any failure or delay in performing its obligations under these Terms, including event cancellations, due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of terrorism, or governmental restrictions.

Severability

It is our belief that the Terms do not contain any provision contrary to law. However, if any part of the Terms is determined to be illegal, invalid, or unenforceable, you agree that: (a) that part shall nevertheless be enforced to the extent permissible in order to effect the intent of the Terms, and (b) the remaining parts shall be deemed valid and enforceable.
